Coronavirus: ‘Homeless’ man charged for being outside ‘without reasonable excuse’ under lockdown law

英國頒布肺炎封城令,一名無家可歸的45歲男子 Mr. Monsour 因為「無正當理由不待在家裡」被警方逮捕並且面臨審判,因為他不承認自己有罪。
封城令禁止人民無正當理由離開或不待在自己的住居所。不過法條中其實有註明不適用於「無家者」。

A man who claims to be homeless has been charged with being outside “without reasonable excuse” during the coronavirus lockdown.

Sultan Monsour, 45, faces trial after pleading not guilty to an offence under the Health Protection (Coronavirus) Regulations. They make it illegal for anyone to “leave or be outside of the place where they are living without reasonable excuse”. But the law states that the restriction “does not apply to any person who is homeless”.

承審法官說:「這法規不是應該不適用於無家者嗎?如果一個人沒有家,他要怎麼離開家?」
檢察官回答:「被告曾告訴警方說他擁有一個住址,因此符合法定要件。」
不過法官說他所聽到的逮捕名義是因為「被告無家可歸。」法官對流浪漢先生說:「我請求檢方先回去查證一下,他們到底是以什麼罪名起訴你。」

District judge Alexander Jacobs asked: “Is it not a defence that the regulation doesn’t apply to a person who is homeless?” “If he is homeless then the charge ‘that he left the place he was living, namely no fixed address’ doesn’t make sense to me.”

Mr Pakenham(the prosecutor) replied: “He told police he had an address, which seems to satisfy the conditions.”

But the judge said that an account given by the arresting officer said he was “arresting him for breaching coronavirus conditions because he had no address”. He told the defendant: “Mr Monsour, I’m inviting the prosecution to look at the charge again and make it plain how they put the charge against you.”

檢察官約莫一小時後返回,宣稱檢方將繼續對被告起訴。訴狀上寫著:「2020年5月5日,在倫敦利物浦街車站,無特許或正當理由不待在家裡,亦即無固定地址或拒絕提供詳細地址。」

這只是眾多類似案件中的其中一件,當中有些人是沒有固定地址,有些人則是未提供明確居所。

prosecutor returned after an hour and said the CPS would be proceeding with the charges to trial.

The charge reads: “On 05/05/2020 at the entrance to Liverpool Street Station, London, during the emergency period, without reasonable excuse, other than as permitted by the regulations, [you] were outside of the place where you were living, namely no fixed address or refused to provide your address details.”

It is one of several cases under coronavirus laws against people listed as “of no fixed address”, although the designation is also used for people who have not confirmed where they live.

  1. trial /ˈtraɪəl/ 審判。➤ Longman Dictionary
    trial 很容易跟 trail 搞混!
    trail /treɪl/ 是拖行、落後、行跡的意思。
    因為trial的字根是 try,是try的名詞,衍生試驗、審驗的意思。
    trail的字根跟 train火車一樣,所以就是拖在後面一長串的感覺~
    這樣就不會記錯發音跟拼法了 B-)
  2. plead guilty/ not guilty 認罪/不認罪。➤Longman
    plead 是懇求的意思,不只是請求,而是真誠地拜託(in a sincere and emotional way)。所以plead guilty 懇請賜罪,就是認罪的意思啦~通常用於認罪協商之類的。
  3. an offence under~law 觸犯某項法律。
    offence只是應是英文的offense,我還以為是寫錯字。
  4. They make it illegal 這邊為什麼用現在式不是過去式呢?我想了一下,可能是因為法規目前仍然是這樣禁止,所以是事實陳述。如果用過去式好像以前違法,現在已經合法了。
  5. defence /dɪˈfens/ 抗辯。➤ Longman
    defence也是英式英文的defense。不只有防守、防衛之意,法庭上的抗辯也是用這個詞(所以說法庭上的攻防啊~)。
  6. namely /ˈneɪmli/ 即,亦即。
    不是什麼「名義上」之類的意思,就是”即”。請看例句 ➤Longman
  7. breach /briːtʃ/ 違背。➤Longman
    breach the law/ trust/ contract 違背法律/ 信用/ 契約。
    違背法律有很多字可以用,如前面的offend,breach,還有break, violate, infringe, contravene, bend, disobey, against, contrary…這些後面都可以直接 + the law. ➤see thesaurus
  8. defendant /dɪˈfendənt/ 被告。➤Longman
    專指法庭上的被告,沒有其他什麼「防衛者」之類的意思。
    附帶一提,原告叫plaintiff,怎麼記呢?plaintiff的字根跟complaint一樣是plaint,就是抱怨、投訴的意思,到處投訴的人就是原吉。
  9. put the charge against 起訴[此處charge可數]。➤Longman
    可以用 put someone on a charge of something.
    但是 put someone in charge of something 是讓某人負責承辦某事之意。
  10. designation /ˌdezɪɡˈneɪʃən/ 指稱,名目。a name or title.➤Longman
    在這段文意我認為應該是指法規中所說的要件的意思。
